It has been almost 2 years since the ‘unfair contract terms’ law in Australia drastically changed, marking a fundamental shift in contract law and businesses’ ability to limit their liability and protect their commercial interests.
Despite this passage of time, the change has still flown under the radar for many companies (SMEs in particular) who still fail to appreciate:
a) the considerable risk they face by continuing to rely on unfair contract terms (liability of up to $50,000,000 or more per contravention – that’s per unfair term, per applicable contract – and the contract doesn’t even need to be entered into – just proposed).
b) the commercial and negotiating benefits they can derive from the new law.
The seminar will provide a refresher on the changes to the law and what constitutes an unfair contract term, plus a brief update on how the Courts have clarified the law since it came into effect. It will also offer guidance to help attendees identify if their business is at risk and how to utilise the law to their commercial benefit.
The seminar will be presented by Marcus Pullen, Partner at Jackson McDonald, who will provide clarity on what these changes mean for business owners.
